Ex-Missouri State University student gets probation for rape

A now-former Missouri State University student was sentenced Friday to five years of probation for raping a fellow student in 2018.

David Gonzales, 23, was given the sentence Friday morning at a hearing in front of Judge Calvin Holden.

Holden found Gonzales guilty of second-degree rape, sodomy and sexual abuse following a bench trial in July.

According to court documents in the case, the victim let Gonzales stay the night at her home in January 2018 because he was intoxicated and he forced himself on her.

Court documents say the woman told Gonzales she did not want to have sex with him, but he proceeded and told her to “let it happen.”

Months later, the woman called Gonzales during a recorded conversation that law enforcement refers to as a “cold call.” During the conversation, Gonzales apologized and said “I raped you,” according to court documents.

The second-degree rape charge carried a possible seven-year prison sentence.

During Friday’s sentencing hearing, Assistant Greene County Prosecutor John Herries asked for Gonzales to be sentenced to four years in prison.

“We believe that this victim is worth more than probation,” Herries said.

Herries said that in addition to this case, Gonzales had also been accused of sexually abusing a different woman and having sexual contact with a 12- or 13-year-old when he was 17 or 18. Gonzales has not been criminally charged in connection with those other allegations.

Dee Wampler, one of Gonzales’ attorneys, said 34 people submitted letters to the court vouching for Gonzales’ character.
